  2. The online shop www.iwonagorczyca.com/sklep carries out sales of goods through the Internet.
  3. Placing an order in the online shop www.iwonagorczyca.com/sklep is equivalent to accepting these Rules.

Placing a purchase order

  1. Orders may be placed in the following manner:
    • through the agency of www.iwonagorczyca.com/sklep in a dedicated form, or
    • by phone – under +48 501 510 225.
  2. You must register on the shop site to be able to make an order through www.iwonagorczyca.com/sklep. In order to set up an account you must fill in the registration form by providing the basic data necessary for the order to be completed. Upon making the registration, the Customer consents for their personal data to be collected, stored and processed in order to complete the order.
  3. After the order is placed an e-mail with the order particulars is sent to the e-mail address provided in the form.
  4. Before the order is sent the Customer may modify or cancel it. In the event of goods made on individual order, cancellation or change of order particulars is not possible.
  5. The shop: www.iwonagorczyca.com/sklep reserves the right to withdraw from completing the order if the Customer fails to provide all necessary data.
  6. All prices are given in PLN and are inclusive of the 23% VAT. The price given in each product is binding on the moment of placing the order by the Customer.
  7. The shop reserves the right to change prices, to introduce new products and withdraw the existing products from the online shop, launch and stop promotional campaigns and introducing changes thereto.

Payment methods

  1. The payments for orders placed at www.iwonagorczyca.com/sklep may be made through the following means:
    • Bank wire transfer to the indicated account
      If you select this manner of payment, you will receive a bank account number in mBank and transfer data in an e-mail confirming the order placed.
    • Fast online payments – by card or online – via PayPal and Przelewy24. If you select on-line payments you will be redirected to the page where you can make your payment safely.
  2. The date of payment shall be the date of crediting the funds to the shop’s bank account.
  3. If your payment is not credited to the bank account of www.iwonagorczyca.com/sklep within 7 days from placing the order, the order will be cancelled automatically.
  4. The completion of the order will be proceeded once the payment is credited to the bank account, Przelewy24 account or the shop’s PayPal account.

Lead time

  1. The shop www.iwonagorczyca.com/sklep takes all efforts to ship the products as soon as possible, up to 3 days of crediting the funds to the account. Lead time includes the shipment time.
  2. In exceptional cases the shop reserves the right to change the date of completing the order, of which the Customer will be advised promptly. If this period is prolonged, the Customer may choose to resign from the whole or a part of the order.

Costs and manner of delivery

  1. Orders are shipped through courier companies: Pocztex, DPD and DHL as well as InPost Parcel Lockers.
  2. Depending on the selected form of dispatch, costs of delivery are as follows:
    • Pocztex courier shipment with pre-payment to bank account, Przelewy24 and Pay-Pal – PLN 12.92 (incl. VAT)
      The projected delivery time is 1-2 business days.
    • DPD courier shipment with pre-payment to bank account, Przelewy24 and Pay-Pal – PLN 14.60 (incl. VAT)
      The projected delivery time is 1-2 business days.
    • DHL courier shipment with pre-payment to bank account, Przelewy24 and Pay-Pal – PLN 15.90 (incl. VAT)
      The projected delivery time is 1-2 business days.
    • Shipment to InPost Parcel Locker – PLN 11.02 (incl. VAT)
      The projected delivery time is 1-2 business days.
    • Pocztex courier shipment with cash on delivery – PLN 16.00 (incl. VAT)
      The projected delivery time is 1-2 business days.
  3. As a confirmation of transaction concluded through the online shop www.iwonagorczyca.com/sklep is a receipt or VAT invoice sent to the Customer with the ordered product. If the Customer wishes to receive a VAT invoice, they should notify it immediately upon finishing the transaction by completing data in their profile and adding name of the company and tax registration number (VAT UE).

Returns and complaints

  1. Pursuant to the Act on the Protection of Certain Consumer Rights and the Liability for Damage Caused by Dangerous Products of 2 March 2000, the Customer may resign from the product purchased in our online shop without giving reasons within ten (14) days from the date of receipt of the purchased item.
  2. The return will be accepted if the product sent back to us is not used and not damaged. The returned product shall be sent along with the invoice and receipt and invoice (or a copy thereof) and a written statement on the resignation.
  3. If the products are returned on terms and conditions stated above, the Customer will receive the money equivalent of the purchased product, costs of shipments and commissions for online payments to a bank or PayPal account indicated in the statement referred to above. The cost of returning the product is not subject to reimbursement to the Customer.
  4. If any defects in the products are found or if the shipped product is different than the ordered one, the Customer shall have the right to file a complaint within 2 years from the date of purchase.
  5. The products covered with a complaint may be returned only after a prior contact with the shop. The returned product shall be sent along with the invoice and receipt and invoice (or a copy thereof) and a description of the reason for the complaint.
  6. If the complaint is accepted, the defective product will be replaced with another product without defects, and if this is not possible due to this product being out of stock, the shop will return the Customer the equivalent of the product price or offer the Customer other available goods of the same value. The costs of shipment the defective products shall also be reimbursed to the Customer.
  7. Complaints regarding any mechanical damage which occurred during transport will only be recognised on the basis a complaint report made in the presence of a courier. Upon receipt of the product, the Customer is obliged to check whether it is free from damage which may have occurred during transport.
  8. Complaints regarding discrepancies in the colours of the products resulting from discrepancies in the screen parameter settings with the Customer as well as with the inability to reflect the colours of handmade products will not be taken into account and cannot serve as a basis for the return of the product.
  9. The complaints will be recognised within ten day from their receipt at the latest.

  11. Shipments returned in the cash on delivery mode will not be accepted.

Personal data protection

  1. Pursuant to the Act on the Protection of Personal Data of 29 August 1997 personal data provided by the Customer in the registration form are used solely for the purpose of completing orders.
  2. Data are confidential and are not provided to third parties or other entities.

  2. Do złożenia zamówienia za pośrednictwem strony www.iwonagorczyca.com/sklep niezbędne jest dokonanie rejestracji w sklepie. Założenie konta polega na wypełnieniu formularza rejestracyjnego z podstawowymi danymi niezbędnymi do realizacji zamówienia. Wraz z dokonaniem rejestracji, Klient wyraża zgodę na zbieranie, przechowywanie oraz przetwarzanie danych osobowych do celów związanych z realizacją zamówienia.
  3. Po złożeniu zamówienia na adres poczty elektronicznej podany w formularzu przesłana zostaje wiadomość ze specyfikacją zamówienia.
  4. Jeżeli zamówienie nie zostało jeszcze wysłane, Klient może wprowadzić w nim zmiany lub anulować je. Anulowanie lub zmiana specyfikacji zamówienia nie są możliwe w przypadku zamówienia towarów wykonywanych na indywidualne zamówienie.
  5. Sklep www.iwonagorczyca.com/sklep zastrzega sobie prawo do odstąpienia od realizacji zamówienia w przypadku, gdy dane podane przez Klienta w formularzu rejestracyjnym będą niepełne.
  6. Wszystkie ceny podane są w PLN i zawierają podatek VAT w wysokości 23%. Cena podana przy każdym towarze jest wiążąca w chwili złożenia przez Klienta zamówienia.
  7. Sklep zastrzega sobie prawo do zmiany cen towarów znajdujących się w ofercie, wprowadzania i wycofywania towarów z oferty sklepu internetowego, przeprowadzania i odwoływania akcji promocyjnych oraz wprowadzania w nich zmian.

Sposoby płatności

  1. Za złożone w sklepie www.iwonagorczyca.com/sklep zamówienia zapłacić można następującymi sposobami:

      Po wyborze tego rodzaju płatności Klient otrzymuje numer konta bankowego w banku mBank oraz dane do przelewu w mailu potwierdzającym złożenie zamówienia.

  2. Za datę dokonania wpłaty uznaje się datę zaksięgowania środków na rachunku bankowym sklepu.
  3. Zamówienia, za które zapłata nie wpłynie na konto sklepu www.iwonagorczyca.com/sklep w ciągu 7 dni od daty ich złożenia, zostaną automatycznie anulowane.
  4. Realizacja zamówienia rozpoczyna się po zaksięgowaniu wpłaty na rachunku bankowym, Przelewy24 lub PayPal sklepu.

Czas realizacji

  1. Sklep www.iwonagorczyca.com/sklep dokłada wszelkich starań, by przesyłki wysyłane były możliwie najszybciej, do 3 dni od wpłynięcia pieniędzy na konto. Do czasu realizacji należy doliczyć czas dostarczenia przesyłki.
  2. W wyjątkowych przypadkach sklep zastrzega sobie prawo do zmiany terminu realizacji, o czym niezwłocznie poinformuje Klienta. W przypadku wydłużenia terminu realizacji Klient może podjąć decyzje o rezygnacji z części lub całości zamówienia.

Koszty i sposoby dostawy

  1. Zamówienia wysyłane są za pośrednictwem firm kurierskich Pocztex, DPD i DHL oraz Paczkomatów InPost.
  2. W zależności od wybranej formy wysyłki koszty dostawy przedstawiają się następująco:
    • Przesyłka kurierska Pocztex z przedpłatą na konto bankowe, Przelewy24 oraz PayPal – 12,92 PLN z VAT.
      Przewidywany czas doręczenia wynosi 1-2 dni robocze.
    • Przesyłka kurierska DPD z przedpłatą na konto bankowe, Przelewy24 oraz PayPal – 14,60 PLN z VAT.
      Przewidywany czas doręczenia wynosi 1-2 dni robocze.
    • Przesyłka kurierska DHL z przedpłatą na konto bankowe, Przelewy24 oraz PayPal – 15,90 PLN z VAT.
      Przewidywany czas doręczenia wynosi 1-2 dni robocze.
    • Przesyłka do Paczkomatu InPost – 11,02 PLN z VAT
      Przewidywany czas doręczenia wynosi 1-2 dni robocze.
    • Przesyłka kurierska Pocztex za pobraniem- 16,00 PLN z VAT.
      Przewidywany czas doręczenia wynosi 1-2 dni robocze.
  3. Potwierdzeniem transakcji zawieranej za pośrednictwem sklepu internetowego www.iwonagorczyca.com/sklep jest paragon fiskalny lub faktura VAT, dostarczana Klientowi wraz z zamówieniem. Aby otrzymać fakturę VAT, Klient powinien zgłosić to zaraz po dokonaniu transakcji, uprzednio uzupełniwszy dane w swoim profilu o nazwę firmy oraz NIP (VAT UE).

Zwroty i reklamacje

  1. Zgodnie z ustawą z 2 marca 2000 roku “O ochronie niektórych praw konsumentów oraz o odpowiedzialności za szkodę wyrządzoną przez produkt niebezpieczny” Klient może zrezygnować z towaru kupionego w naszym sklepie internetowym bez podania przyczyny w ciągu 14 dni od daty odebrania przesyłki.
  2. Warunkiem uznania zwrotu jest odesłanie produktu nieużywanego i nieuszkodzonego. Do przesyłki zwrotnej należy dołączyć otrzymaną wraz z towarem fakturę lub paragon (lub ich kserokopię) oraz pisemne oświadczenie o rezygnacji z zakupu.
  3. W przypadku zwrotu towaru na określonych powyżej warunkach, Klient otrzyma zwrot wartości zakupionego produktu, kosztów przesyłki i prowizji za płatności internetowe na wskazany w oświadczeniu rachunek bankowy lub konto PayPal. Koszt odesłania towaru nie podlega zwrotowi.
  4. W przypadku stwierdzenia wad produktów lub niezgodności zawartości przesyłki ze złożonym zamówieniem, Klient ma prawo do zgłoszenia reklamacji w ciągu 2 lat od daty zakupu.
  5. Zwrot reklamowanych produktów możliwy jest tylko po wcześniejszym kontakcie ze sklepem. Do odsyłanego towaru należy dołączyć otrzymany wraz z przesyłką paragon/fakturę (lub ich kserokopię) oraz opis powodu reklamacji.
  6. W przypadku uznania reklamacji towar wadliwy zostanie wymieniony na inny, pełnowartościowy, a jeśli będzie to już niemożliwe na przykład z powodu wyczerpania zapasów, sklep zwróci Klientowi równowartość ceny produktu lub zaoferuje mu inny, dostępny towar o tej samej wartości. Klient otrzyma także zwrot kosztów odesłania wadliwego towaru.
  7. Reklamacje dotyczące uszkodzeń mechanicznych powstałych podczas transportu rozpatrywane będą jedynie na podstawie protokołu reklamacyjnego sporządzonego w obecności kuriera. Odbierając towar Klient zobowiązany jest do sprawdzenia, czy przesyłka nie posiada uszkodzeń powstałych podczas transportu.
  8. Reklamacje dotyczące rozbieżności w kolorystyce towarów wynikającej z różnicy w ustawieniu parametrów monitora Klienta oraz związane z niemożnością jednakowego odwzorowania wykonywanych ręcznie produktów nie będą uwzględniane i nie stanowią podstawy do zwrotu towaru.
  9. Reklamacje rozpatrywane będą najpóźniej w ciągu 10 dni roboczych od ich wpłynięcia.

  11. Przesyłki odsyłane za pobraniem nie będą przyjmowane.

Ochrona danych osobowych

  1. Zgodnie z Ustawą o ochronie danych osobowych z dnia 29 sierpnia 1997 roku dane osobowe podawane przez Klienta w formularzu rejestracyjnym wykorzystywane są tylko w celach realizacji zamówień.
  2. Dane są poufne i nie są udostępniane osobom trzecim ani innym podmiotom.
